eDISCOVERY

img-corporate-services1

eDiscovery is short for electronic discovery, i.e. the process of discovery in civil litigation that is carried out in electronic formats. It includes what is called electronically stored information, or ESI. In a nutshell, eDiscovery is finding all pertinent information to legal proceedings in electronic form.

Examples of the types of ESI which can form part of an eDiscovery investigation are emails, social media posts and messages, any instant messaging chats including Whatsapp/ Messenger/ Instagram messages etc, documents, accounting databases, CAD/CAM files, websites, and any other electronic information that could be relevant evidence in a lawsuit. Also included under the eDiscovery umbrella are “raw data” and “metadata,” which forensic investigators can review for hidden evidence.

img-corporate-services1

In the litigation process, eDiscovery runs from the time a lawsuit is foreseeable to the time digital evidence is presented in court. In general terms the process runs as follows:

circle1

Firstly, electronic data is identified as relevant by both legal teams and placed on legal hold

circle2

Legal teams from both sides determine scope of discovery, identify the relevant ESI, and make eDiscovery requests and challenges. The parameters of the search can be negotiated

circle3

Relevant data is then extracted and analysed using expert digital forensic procedures, and is prepared for use in court

Our litigation experts suggest that companies prepare for potential litigation with data usage and storage policies that ensure:

  • Information without business value is disposed of according to company protocol and in the normal course of business
  • Records that have value to the organisation are stored and managed correctly
  • Implementation of an information and records management structure
  • Records that are no longer needed are destroyed systematically and this process documented

Putting strong processes and protocols in place enables organisations to pull information and records as needed and reduces the effort and cost of reviewing data. Finding data for eDiscovery can be costly and time consuming if you are unprepared. The best litigation defence is to prepare before you have to act.

Pre-Employment Screening

img-corporate-services8

Finding the right person for a key position at your company can be costly. But it can be even more costly if the wrong decision is made at the point of employment. Frequently employers view the information provided in resumes as being accurate and neglect to investigate further. It is unlikely that you have ever been presented with a reference that states that the applicant is a thief, lazy or incompetent. No, they are usually glowing and embellished. Sometimes there are gaps in the employment history that are unexplained or exaggerations of periods of employment to mislead.

A slight exaggeration here or there isn't too problematic - for example, putting “yoga” as a hobby when the applicant in fact mainly watches Netflix isn’t going to do too much harm. However, some job applicants go to great lengths to impress, even to the point of identifying companies who have been recently liquidated or taken over in the hope that prior personnel files have been destroyed. Taking on an unsuitable employee is dangerous, taking on a thief or corporate spy can harm your business beyond repair. In extreme cases, failing to do a Pre-Employment Screening of potential candidates could cost you thousands in the case of a lawsuit or from nefarious business or personal practices.

Group One Investigations can do a deep background dive into prospective employees, making sure they are as they represent themselves to be, and that there is nothing in their personal lives or pre-employment history that will present a problem for employment with your company.
